Fees and Cancellation Policy

A 50% non-refundable deposit is needed for bookings to be secured. Remainder of full payment is required 14 days or more prior to the event.

Covid policy: If Public Health Orders are such that a full lockdown is required, only then will our cancellation policy be waived and payments will be refunded. Our cancellation policy remains in place in all other circumstances, including if government restrictions affect the amount of guests at your event.

Payment of the deposit is considered as acceptance by you of the terms and conditions contained herein.

If Speckles Art has not required a deposit to be paid, these terms and conditions are considered to be accepted once your booking is accepted either in writing or verbally.

As we prepay for supplies that are customised to your event and we decline other booking opportunities for your reserved date, if you cancel a booking within 14 days of your event there is a 50% cancellation fee and within 24 hours of your event there is a 100% cancellation fee. At our discretion we may allow a booking to be rescheduled whereby we hold the funds paid for the initial event to cover the new date and there is a rebooking fee of $100 payable upon rebooking to cover our losses for the initial reserved date.

Extra travel fees may apply to locations outside of the Sydney metro area and you will be notified of this at the time of booking your location with us. Staff will do their best to obtain cheap or free parking spots. Excessive parking fees will be invoiced to be paid by you in the rare event that our entertainers are unable to find viable parking.

Variations to Bookings

Due to the availability of supplies, staff or limitations of the venue we reserve the right to substitute and use alternatives to what is represented on our website. We will notify you in the rare event that an entertainer is in an emergency situation and will be delayed or unable to attend and will attempt to find a replacement entertainer. In the event that we cannot find a replacement entertainer you will be given a full refund.

Speckles Art entertainers always do their very best to provide entertaining and engaging activities. However Speckles Art cannot take responsibility for a child not being engaged, choosing not to partake or disliking an activity, particularly where competing distractions were available simultaneously like play equipment or food or where the ages of the children were very varied as it is harder to design an activity that covers all ages.

Weather Policy
It is highly recommended to have a wet, hot or windy weather indoor Plan B available nearby (within 5km). If you need to move to the indoor Plan B, please provide 2 hours notice so our staff can commute to the correct venue. If you choose to rely exclusively on an outdoor venue, you do so at your own risk. If we are unable to safely or comfortably provide the service due to weather conditions, and in the absence of a viable Plan B and notice provided, we will keep 75% of your payment to cover the cost of our staff’s time to prepare your party kit bag, travel time and expenses and to cover our custom art materials, as well as the loss of revenue for your booking slot.

Limitations on Liability

By placing an order, you agree that you, your child and your event guests use our party entertainment services at your own risk and that you, your child and your event guests are able to take part in our party entertainment activities and that it would not cause harm to you, your child or your event guests.

You agree that you are responsible for ensuring that the children and their parents/caregivers who attend your event and partake in our provided activities meet the minimum age specified by us, or if not specified children must meet the minimum age requirement of above 3 years old. We will not be liable for any loss, injury or damage that is caused by a medical condition or special requirements of you, your child or guests for which you are or should have been aware of that would make participation in our party entertainment activities harmful.

You agree to inform Speckles Art of any special requirements of any child or event guest such as any allergies or other physical, mental or emotional issues, that may impact the activities and entertainment that we would select or provide. You agree to indemnify Speckles Art in the event of any claim resulting from a lack of disclosure or misrepresentation.

You agree that you are responsible for communicating to all guests who are parents or carers of the children at your event that they are responsible for supervising any child in their care at all times (including during the activities we provide) including to closely monitor your or their child’s safety and use of art supplies and other items, especially choking hazards for any child under 3 attending your event who may try to access small art supplies. You agree to inform all guests that you invite to your event that they are responsible for supervision and that they are responsible for deciding whether the activities provided by us are appropriate and safe for their child to partake in.

In addition to the above, you agree that either yourself or another nominated adult will remain present for the duration of the event, and will be responsible for supervision of the activity in addition to the attending parents and caregivers, and that you will advise Speckles Art of who that supervising adult is prior to the commencement of the entertainment such that we always have point of contact throughout the event.

You agree that Speckles Art will not be liable to you or any other persons for any loss, damage, injury or expense while participating in the event or entertainment, whether by our act, omission or negligence or as a consequence of you or another guest not following our instructions during the provision of our party entertainment activities. Speckles Art will not be held responsible for the behaviour of any child or other person attending your event. You agree to indemnify Speckles Art in relation to any loss, injury or damage.

Intellectual Property and media use

Intellectual property rights belong to us including any materials provided to you or your guests during our party entertainment activities. You must not allow any other person to access materials or information provided to you by Speckles Art during booking or the provision of the services.

Photography and media use. Parents are welcome to take photos and videos of their child throughout any of our entertainment activities and may share these on social media. However, this is at the discretion of the entertainer who may withdraw this right at any time where a guest or other person is acting unreasonably (such as delaying us providing our services, taking excessive photos or filming long portions of our activities).

By accepting our terms and conditions, you give consent for Speckles to take photographs or videos of the party and party entertainment activities for marketing and/or publicity use including your child, venue and guests, within reason (e.g. in order to photograph our entertainment services).

Referral Fees

Speckles may pay or receive a commission for the add-ons of other services which are fulfilled by other providers, such as cakes, balloon decorating, event styling and so on. Speckles may pay a commission to an event planner or other business when they refer a customer to us.

Other

If a court finds part of this contract illegal, the rest will continue and each of the paragraphs of these terms operates separately.
